The Supreme Court on Monday agreed to hear the Centre’s plea to review the 2018 verdict that excluded creamy layer within Scheduled Caste (SC) and Scheduled Tribes (ST) from reservation benefits.
A bench led by Chief Justice of India (CJI) SA Bobde is scheduled to hear the case after two weeks.
Attorney General KK Venugopal who had appeared for the Centre urged the apex court to refer the judgment to a seven-judge bench.
On September 26, 2018, a five-judge bench had stated that affluent or creamy persons belonging to the SC/ST communities cannot be granted reservations for college admissions or government jobs.
In 2018, the apex court had ruled that states no longer need to collect quantifiable data on the backwardness of SCs and STs in granting quota in promotions, but will have to back it with data to show their inadequate representation in the cadre.
It had also refused to refer the judgment to a seven-judge constitution bench.
