The Manipur Parliamentary Secretary (Appointment Salary and Allowances and Miscellaneous Provisions) Act 2012 has been repealed following an official gazette notification passed by the State Government on Thursday.
The notification stated that ‘it is expedient to repeal the Manipur Parliamentary Secretary (Appointment Salary and Allowances And Miscellaneous Provisions) Repealing Act, 2012 in the light of the ruling of the Supreme Court of India in transfer case (civil) no 169 of 2006’ and in the process of being a responsible government which upholds the rule of Law.
It also mentioned that repeal of the Parliamentary Secretary Act, 2012 shall not affect the previous operation of the repealed act or anything duly done in pursuance of the Act so repealed including anything done in official discharge of their duties by the parliamentary secretaries or any right, privilege or obligation incurred under the repealed Act.
Earlier, the matter was heard on Thursday in connection with the PIL filed by four MLAs, Surjakumar Okram, A Sushilkumar Singh, Rajkumar Joysana Singh, and Md Sabir Ahmad before the High Court of Manipur against the Parliamentary Secretary (Appointment Salary and Allowances And Miscellaneous Provisions) Repealing Act, 2012.
During the hearing, the state government through its counsel submitted the official gazette notification which passed.
The copy of the gazette notification was furnished to the petitioner counsels and later they requested to the court to give some days to study the said gazette notification.
The court while accepting the request of the petitioner counsels has given them 10 days’ time to study the gazette notification.
