A Dibrugarh court here on Wednesday rejected the petition filed by Dudhnoi police seeking permission for arresting Krishak Mukti Sangram Samiti (KMSS) chief Akhil Gogoi in a fresh case registered against him at Dudhnoi police station.

The Additional Chief Judicial Magistrate of Dibrugarh Court Imdad Ahmed rejected the petition filed by inspector Swapan Kumar Roy of Dudhoni police station seeking custody of Gogoi.

Roy is the investigating officer of the case registered against Gogoi at Dudhnoi police station.

KMSS chief Gogoi, who is currently lodged in Dibrugarh jail, was rearrested on September 25 under National Security Act (NSA) on charges of waging war against the nation. On September 13, the Assam police slapped sedition charge on Gogoi.

“A case was registered against Gogoi at Dudhnoi police station during a protest at Dudhnoi. A case (no 112/17) under section 143/147/437 /120 (B) of PDPA Act was registered against him. But Gogoi didn’t know as to when the case was registered,” Gogoi’s counsel Anuj Chetri said.

He said that the Guwahati High court will give a decision on bail plea of Gogoi in connection with the NSA case on Thursday.

The police had submitted the chargesheet on December 13 against Gogoi in connection with the case (no 180/17) registered at Moran police station.

As many as seven charges were slapped against the KMSS leader including sedition (Section 124-A) and attempting to wage war against the government (Section 121).

The KMSS leader was arrested by the police following his alleged provocative speech at a public rally in Moran where he allegedly appealed to the people to take up AK-47 rifles in their movement against the government.
